Exclusivity clause

What is an exclusivity clause?

An exclusivity clause restricts a creator from working with a brand’s competitors for a set period, in exchange for the deal they’re signing.

What does an exclusivity clause mean in influencer marketing?

It protects the brand’s investment by preventing a creator from promoting a rival product soon after — or during — a campaign, but it also limits the creator’s income from that category for the clause’s duration.

What should creators watch out for with exclusivity clauses?

  • Define "competitor" narrowly and specifically — vague exclusivity language can accidentally block entire categories of future work.
  • Set a clear end date; open-ended exclusivity has no expiry and can quietly restrict you indefinitely.
  • Charge a premium for exclusivity — it’s a real cost to you and should be priced as one, not bundled in for free.
